It has been argued frequently that peer-to-peer file sharing networks (like the old Napster) were beneficial to people looking for out-of-print, rare, and bootleg recordings. It's a rare and valuable opportunity that we can ask a living artist about this argument.

Assuming the worst, that Sony will not now nor ever release your recording, what do you think of your CD shared on one of the file-sharing services.

You would not be getting any royalties from this kind of distribution, but you are currently not getting any royalties from Newport/Sony. The benefits are that you would be exposing this music to a wider audience, and you would be promoting the Moersch name in the event that you would make any future recordings.

I realize that it is difficult for you to give a blanket endorsement of peer-to-peer networks because 1) you have a legal obligation to Sony, and 2) you would be compromising any royalty collection process between ASCAP/BMI/etc and the composer.

Nevertheless, I would love to hear your opinion about peer-to-peer file sharing networks where they concern out-of-print recordings.
