Speaking purely in the abstract, I would think that file-sharing of permanently out-of-print recordings may be appropriate. However, there are still copyright issues at hand. If an artist owns the rights to their own material, then it is their choice to provide it in such a manner. On the other hand, if they do not own the rights, then anyone takes a risk placing that material into a file-sharing situation.
